Terms and Conditions

User Agreement

  1. Article 1 (Purpose)

    The purpose of these Terms and Conditions is to prescribe the rights, duties, and responsibilities of the users of the Internet-related services (here inafter referred to as the "service” or “services”) provided via the online channel of Seoul Danurim Accessible Tourism (hereinafter referred to as “ SDT”) operated by the Seoul Tourism Organization (business operators according to e-commerce and telecommunications business related law).

  2. Article 2 (Definitions)
    1. ① The term "SDT" refers to the real-time platform, as well as the website and application used for its operation, provided by the operating center i n order for the Seoul Metropolitan Government to provide barrier-free tourism information and services.
    2. ② The term "user" refers to a member or non-member who accesses the SDT and receives any of the services provided under these Terms and Co nditions.
    3. ③ The term "member" refers to a person registered as a member of the SDT who has been permitted to use the continuously provided services.
    4. ④ The term “non-member" refers to a person who uses the limited service content provided by the SDT that do not require that they be registered as a member.
    5. ⑤ The term "booking service" refers to the application via information and communications equipment, such as a computer or mobile device, to a service provided by the Seoul Danurim Accessible Tourism Center.
  3. Article 3 (Clear Statement, Description, and Revision of the Terms and Conditions, etc.)
    1. ① The SDT will post the contents of the Terms and Conditions, their trade name, address where the business office is located, telephone number, email address, etc., on the main service screen of the SDT to ensure that they are easily accessible by users. However, details of the Terms and Con ditions of the SDT may be displayed on a page connected to the main page through a link for users to view them.
    2. ② Before a user agrees to the Terms and Conditions, the SDT must provide a link to a separate window or sub-window so that the user may learn about important details such as details regarding withdrawal of subscription, refund conditions, etc., in order for the SDT to obtain the full consen t of the user.
    3. ③ The SDT may amend the terms and conditions to the extent that it does not violate relevant laws, such as the “Enforcement Decree of the Act o n the Consumer Protection in Electronic Commerce, etc.,” the “Act on the Regulation of Terms and Conditions,” the “Framework Act on Electronic Documents and Transactions,” the “Digital Signature Act,” the “Act on Promotion of Information and Communications Network Utilization and Inf ormation Protection, etc.,” the “Act on the Prohibition of Discrimination against Persons with Disabilities, Remedy against Infringement of their Ri ghts, etc.,” and the “Framework Act on Consumers.”
    4. ④ If the SDT intends to modify the Terms and Conditions, it will specify and notify the effective date and the reason for modification on the home screen of the SDT continuously for at least 15 days prior to the effective date, along with its current Terms and Conditions. However, if the modific ation to the details of the Terms and Conditions is unfavorable to the users, it must be notified with a grace period of at least 30 days. In this case, the details before and after the modification to the SDT will be clearly contrasted and displayed to make it easier for users to understand.
    5. ⑥ Matters not set out in these Terms and Conditions and the interpretation thereof will be governed by the Act on the Consumer Protection, in Ele ctronic Commerce, etc., the Act on the Regulation of Terms and Conditions, and the Guidelines for Consumer Protection in Electronic Commerce, etc., and relevant statutes or commercial practices.
  4. Article 4 (Provision and Modification of Services)
    1. ① The SDT provides both non-membership services and membership services and membership services entail the provision of the following infor mation.
      1. 1. Provision of goods or services that have been applied to be reserved;
      2. 2. Miscellaneous duties of the SDT.
    2. ② Service content may be modified if any changes are made to the SDT's products, information and service quality, or technical specifications. In these cases, the modified product, information, or service contents and the date of provision will be immediately notified via the place at which t he current product, information, or service content is posted.
    3. ③ If a modification is made due to a change in the SDT's product, information, or service quality or technical specifications, users will be immedia tely notified of the reason thereof.
    4. ④ In cases falling under the preceding paragraph, the SDT will compensate the user for any resultant damages. However, there will be no compen sation in cases where the SDT demonstrates its lack of intention or negligence thereof.
  5. Article 5 (Service Duration and Suspension)
    1. ① The service duration for members will be from the date the user receives approval after they have submitted a service application until the date the user withdraws from the SDT service.
    2. ② The SDT may temporarily suspend the service if there arises a reason to do such, such as repairs, inspection, replacement, or failure of informat ion and communications equipment, like computers, and in such cases, the suspension of service and the reasons thereof will be notified on the home screen of the website.
    3. ③ If the SDT is unable to provide services due to a natural disaster or because of a policy of the Seoul Metropolitan Government (like the announc ement of reduced outdoor activities as a measure to reduce particulate matter, etc.), the provision of services may be restricted or suspended tem porarily.
  6. Article 6 (Notice for Members)
    1. ① The SDT may notify members via an email address designated in agreement with the member in advance.
    2. ② The SDT may post notices that apply to a large number of unspecified members on the SDT bulletin board for at least one week, in lieu of indivi dual notifications. However, individual notifications will be sent regarding matters that have a significant impact on the transactions of members.
  7. Article 7 (Service Charges)
    1. ① The SDT is provided free of charge.
    2. ② Under special circumstances, where required services are provided and charges (services charges) are levied accordingly, services may be conv erted to paid services.
  8. Article 8 (Application for Use and Consent to the Provision of Personal Information, etc.)
    1. ① SDT users will be required to apply for use of the SDT in the following or similar manner, and the SDT must provide the following information in an easy-to-understand manner when the users file an application.
      1. 1. Search and selection of products and services, etc.;
      2. 2. Entry of the recipient's name, e-mail address, mobile phone number, etc.;
      3. 3. Confirmation of the Terms and Conditions;
      4. 4. A mark (for example, a mouse click) confirming or denying the matters listed under Subparagraph 3 above after agreeing to these Terms and Co nditions.
      5. 5. Application for goods, information, services, etc., and the confirmation thereof or confirmation from the SDT
      6. 6. Selecting how to use
    2. ② If the SDT is required to provide personal information to a third party for service use, such as for booking, it must inform the booking member o f 1) the party to be provided with the personal information, 2) the purpose for which that party will use the provided personal information, 3) the i tems of personal information to be provided, and 4) the period of retention and use of personal information by the party to be provided with the p ersonal information, and the SDT must obtain the user's consent. (The same will apply is these matters are modified.)
  9. Article 9 (Formation of Booking Services)
    1. ① The SDT is permitted to not approve an application for use in Article 3 under any of the following circumstances. However, it is necessary there i t a notification information readers that if a minor wishes to apply for use but fails to obtain the consent of their legal representative, the minor or the minor's legal representative may cancel the agreement.
      1. 1. If there is a false, omitted entry or an error in the application;
      2. 2. If a minor uses products or services prohibited by the Youth Protection Act, such as tobacco or alcoholic beverages;
      3. 3. If it is deemed that the approval of the application for use would cause significant impairment to the technology of the SDT.
    2. ② When the approval of the SDT reaches the user in the form of a receipt notification under Article 12, Paragraph 1, the approval for use will be de emed to have been established.
    3. ③ The manifest of intention of approval by the SDT must include information regarding the user's confirmation of application and the availability of, cancellation of, or modification to the application, etc.
  10. Article 10 (Service Use Method)
    1. ① The use of the products, information, or services of the SDT may be carried out via any of the following methods:
      1. 1. Free services;
      2. 2. Paid services.
  11. Article 11 (Receipt Confirmation Notification, Modification, or Cancellation of Application)
    1. ① If an application to use the SDT is made, the user will be notified via a receipt confirmation.
    2. ② A user who has received a receipt confirmation notification may request modification or cancellation of the application immediately after recei ving the receipt confirmation notification if there is some discrepancy, etc., with regards to their intention and if a request for use has been filed a s an SDT member the request must be processed without delay. However, if a service that requires payment is provided, this shall be governed by the provisions of Article 15 on withdrawal of subscription, etc.
  12. Article 12 (Refunds)
    1. ① If the SDT is unable to provide paid products, information, services, etc., for which the user has applied, it must notify the user of the cause ther eof and, if payment has already been made for the products, etc., it must refund the sum or initiate the measures necessary for a refund within fiv e days from the date on which the cause arose.
  13. Article 13 (Cancellations, etc.)
    1. ① A user of SDT products and services may make a cancellation request according to the cancellation or refund policy for each product.
    2. ② A user may raise an objection within 30 days from the date of receipt of the relevant product, etc., or within 7 days from the date on which the u ser has become aware of the fact that the contents of the product, etc., have provided in a manner different from how it was displayed or advertis ed.
  14. Article 14 (Effects of Withdrawal of Subscription, etc.)
    1. ① Upon the receipt of a request by an SDT user to withdraw from their subscription, the sum for the product, etc., already paid will be refunded w ithin 7 business days after confirming that the request is reasonable. In this case, if the SDT is late in refunding a product, etc., the interest for arre ars calculated by multiplying the interest rate for arrears prescribed in Article 21-2 of the Enforcement Decree of the “Consumer Protection, in Elec tronic Commerce, etc. Consumer Protection” must be paid for the period of delay.
    2. ② The SDT will refund the above sum through the relevant agency and if the user has paid the sum for the product, etc., via a payment means suc h as a credit card or electronic currency, etc., it will request the business operator who has provided the relevant payment to suspend or cancel th e payment for the product, etc., without delay.
    3. ③ The user will bear the cost required for the return of the product, etc., supplied, including subscription cancellation. The SDT will not claim resp onsibility for any penalties or damages caused to the users that arises due to their cancellation of subscription. However, if the contents of the pro duct, etc., differ from the how the content was advertised and thus the subscription is withdrawn from, the SDT will bear the necessary expenses f or the return of the product, etc.
  15. Article 15 (Protections for Personal Information)
    1. ① When collecting the personal information of SDT users, the minimum amount of personal information will be collected within the scope necess ary for providing services.
    2. ② The SDT collects the minimal specific personal information necessary for identify verification purposes prior to service use so as to provide sm ooth services.
    3. ③ If the SDT intends to collect and use the personal information of users, it will notify the users of the purposes thereof and obtain their consent.
    4. ④ The SDT is prohibited from using collected personal information for any purpose other than those originally intended, and in cases where new purpose for use of that information arises, it will notify users of such purposes and obtain their consent at the use and provision stage. However, t his will not apply to cases where the relevant laws provide otherwise.
    5. ⑤ When the SDT is required to obtain user consent under Paragraphs 2 and 3, it must clearly provide in advance or notify the matters prescribed u nder Article 22 (2) of the “Act on Promotion of Information and Communications Network Utilization and Information Protection, etc.,” such as the privacy officer’s identity (affiliation, name and telephone number, other contact information), the purpose of collection and use of information, a nd the matters related to the provision of information to third parties (the parties provided with, the purpose of provision, and the content of the i nformation to be provided), and the users may withdraw their consent at any time.
    6. ⑥ A user may request to access and correct their personal information that is possessed by the SDT at any time, and the SDT is obliged to take the necessary actions without delay. If the user requests a correction of an error in their information, the SDT will not use the personal information un til the error is corrected.
    7. ⑦ The SDT must limit the personnel who handle personal information to a minimum to protect the personal information of users and will remain fully liable for damages sustained by users due to the loss, theft, leakage, unauthorized provision to a third party, tampering, etc., of the user's per sonal information including their credit cards, bank accounts, etc.
    8. ⑧ The SDT or a third party who has received personal information must destroy the personal information without delay once the purpose of colle ction and receipt of personal information is fulfilled.
    9. ⑨ The SDT must not pre-select consent for the collection, use, and provision of user's personal information. In addition, the SDT will specify, in de tail, the services restricted if the user does not consent to the agreement on the collection, use, and provision of personal information, and the SD T will not restrict or refuse to provide services such as membership subscriptions for reasons such as the denial of agreement by users on the coll ection, use, or provision of personal information that is not subject to mandatory collection.
  16. Article 16 (Duties of the SDT)
    1. ① When collecting the personal information of SDT users, the minimum amount of personal information will be collected within the scope necess ary for providing services.
    2. ② The SDT must be equipped with a security system to protect users' personal information (including credit information) to ensure that users feel safe to use the SDT's Internet services.
    3. ③ The SDT will be held liable for any damage caused by the SDT engaging in unfair labeling or advertising as prescribed under Article 3 of the “Act on Fair Labeling and Advertising” for its products, information, and services.
    4. ④ The SDT will not send commercial e-mails unwanted by users.
  17. Article 17 (Duties of Members with Regards to IDs and Passwords)
    1. ① Except for cases related to Article 14, each member will remain responsible for the management of their own ID and password.
    2. ② A member must not allow a third party to use the member's ID and password.
    3. ③ If a member becomes aware that their ID and password have been stolen or is being used by a third party, they must notify the SDT immediatel y and follow the instructions provided by the SDT.
  18. Article 18 (Duties of Users)

    A user must not engage in any of the following:

    1. ① Registering false information upon application or modification;
    2. ② Stealing the information of others;
    3. ③ Modifying information posted on the SDT;
    4. ④ Transmitting or posting information (such as computer software) other than the information required by the SDT
    5. ⑤ Infringing upon intellectual property rights, such as copyrights of the SDT or those of third parties;
    6. ⑥ Defaming or interfering with the work of the SDT or a third party;
    7. ⑦ Disclosing or posting obscene or violent messages, videos, voice memos, or other information that interferes with public order or the good nat ure of the site.
  19. Article 19 (Attribution and Restrictions for Copyrights)
    1. ① The copyrights and other intellectual property rights for works created by the SDT will be claimed by the SDT.
    2. ② Users are prohibited from using information with intellectual property rights claimed by the SDT for profit by means such as the duplication, tr ansmission, distribution, broadcasting, or any means of provision to a third party without prior approval of the SDT.
    3. ③ If the SDT intends to use a copyright claimed by a user, it must notify the user of how it will use such a copyright according to the Terms and Co nditions.
  20. Article 20 (Dispute Resolution)
    1. ① The SDT may organize and operate a damage compensation body to reflect on reasonable requests or complaints presented by users and provi de compensation for related damages.
    2. ② The SDT will process complaints and requests submitted by users in the order they are received. However, if it is difficult to rapidly process thes e matters, the SDT will immediately notify the users of the reasons thereof and the processing schedule.
    3. ③ If there is an application for remedy of damages caused by an e-commerce dispute between the SDT its users, they may be subject to mediatio n by the Fair Trade Commission or the dispute settlement agency commissioned by the mayor or provincial governor.
  21. Article 21 (Jurisdiction and Governing Law)
    1. ① The Terms and Conditions will be governed by the laws of the registered address at which the SDT is located and if no such address exists, the d istrict court in the principal place of business of the SDT will be the court of exclusive jurisdiction. However, if the user's address or place of domici le is not clear at the time of filing a complaint, or if that user is an overseas resident, they must file a complaint to the competent court of jurisdicti on under the Civil Procedure Act.
    2. ② Lawsuits in connection with e-commerce and communications network laws filed between the SDT and its overseas users will be governed by and construed in accordance with the laws of the Republic of Korea.
